{"id":1306,"date":"2013-07-02T17:00:09","date_gmt":"2013-07-02T16:00:09","guid":{"rendered":"http:\/\/bsb.lasunison.com\/?p=1306"},"modified":"2013-07-02T21:42:59","modified_gmt":"2013-07-02T20:42:59","slug":"have-a-break-have-a-mish-mash","status":"publish","type":"post","link":"https:\/\/ericsblog.lasunison.com\/?p=1306","title":{"rendered":"Have A Break &#8211; Have A Mish-Mash!"},"content":{"rendered":"<p><strong>Agenda for Change (AfC)\u00c2\u00a0is nearly ten years old and here we are, like most other Ambulance Services, still trying to sort out Rest Breaks for operational staff. <\/strong><\/p>\n<p><strong>We can&#8217;t even decide if it is a rest break or a meal break!\u00c2\u00a0Woe betide staff\u00c2\u00a0resting on a meal break or eating on a rest break!<!--more--><\/strong><\/p>\n<p><strong>The Rest\/Meal Break provisions in all Ambulance Services are a mish-mash!<\/strong><\/p>\n<p><strong>It needn&#8217;t be like that if someone would only make the sensible decision to make all\u00c2\u00a0the rest\/meal break paid, and not unpaid.<\/strong><\/p>\n<p><strong>In other words, change the wording of Section 10.1\u00c2\u00a0in the AfC National Handbook from <em>&#8216;37.5 hours a week &#8216;excluding&#8217;<\/em>\u00c2\u00a0<em>meal breaks&#8217;,(<\/em>note it says meal break and not rest break<em>)<\/em>\u00c2\u00a0to <em>&#8216;37.5 hours a week &#8216;including&#8217;\u00c2\u00a0meal breaks&#8217;.<\/em><\/strong><\/p>\n<p><strong>Throw out the <em>ex<\/em> and put in the <em>in<\/em>!. Great slogan\u00c2\u00a0for our next demonstration!: &#8220;Throw out the Ex and put in the In! Throw out the Ex and put in the In!&#8221;<\/strong><\/p>\n<p><strong>It is that one word that is causing all the problems. It is that one word that is\u00c2\u00a0actually the barrier, most of the time, that prevents staff having a break, and it is that one word that causes the problems in cover which results in bad press.\u00c2\u00a0<\/strong><\/p>\n<p><strong>Unpaid rest\/meal breaks\u00c2\u00a0may have been\u00c2\u00a0designed to give Services more freedoms but, in reality, they have fenced them in.<\/strong><\/p>\n<p><strong>That decision will have to be made at a national level by NHS Employers. But, while they contemplate their\u00c2\u00a0navels (which is called Omphaloskepsis by the way!), twiddle their thumbs and fiddle while Rome (or dinner) burns, we are left at local and regional level with a mess.<\/strong><\/p>\n<p><strong>It is about having control in a positive way. <\/strong><\/p>\n<p><strong>Our current rest\/meal break agreement isn&#8217;t perfect by any means, but is\u00c2\u00a0what being proposed\u00c2\u00a0an improvement? <\/strong><\/p>\n<p><strong>Is justifying having &#8216;food on the hoof&#8217; by pedantically splitting hairs over rest break v meal break an improvement?<\/strong><\/p>\n<ul>\n<li><strong>Staff should have a break. <\/strong><\/li>\n<li><strong>Staff should have proper facilities for that break. <\/strong><\/li>\n<li><strong>Staff should be compensated if they do not have a break. <\/strong><\/li>\n<\/ul>\n<p><strong>Three simple rules! This is all we ask. <\/strong><\/p>\n<p><strong>We\u00c2\u00a0understand that the decision regarding inclusive rest\/meal breaks may well be out of the Service&#8217;s hands (although in this brave new world why not lead the way) but a fair, respectful policy\u00c2\u00a0should be\u00c2\u00a0well within our grasp.<\/strong><\/p>\n<p><strong>We are talking about people doing a difficult job who are entitled to rest and sustenance. <\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Pie &amp; Mash and\u00c2\u00a0not Mish &amp; Mash!<\/strong><\/p>\n<p style=\"text-align: center;\">____________________<\/p>\n<p style=\"text-align: left;\"><strong>We have been having meetings on a National level within the Joint National Staff Council.<\/strong><\/p>\n<p><strong>These talks have been concentrated on Annex E and the recent changes to Agenda for Change.<\/strong><\/p>\n<p><strong>In simple terms the\u00c2\u00a0NHS Employers and Ambulance Service Employers take the view that the recent change to the\u00c2\u00a0AfC withdrawing Unsocial Hour Payments while off sick also applies to health staff covered by Annex E (staff in Ambulance Services\u00c2\u00a0are covered by Annex E within the National Handbook).<\/strong><\/p>\n<p><strong>UNISON and other Unions involved\u00c2\u00a0do not believe that these deductions while off sick apply to staff under Annex E.<\/strong><\/p>\n<p><strong>NHS\u00c2\u00a0Employers think it applies &#8211; We do not.<\/strong><\/p>\n<p><strong>A proposal regarding how this will work has been given to the Unions.<\/strong><\/p>\n<p><strong>We are to ballot those\u00c2\u00a0members working under Annex E\u00c2\u00a0for their views.<\/strong><\/p>\n<p><strong>More information will be sent out soon.<\/strong><\/p>\n<p><strong>T<\/strong><strong>he following is a statement sent from the Union at national level:<\/strong><\/p>\n<p><em><b>&#8220;As you know, the impact of the recent Agenda for Change changes on Annex E sickness payments has been the subject of contention!\u00c2\u00a0\u00c2\u00a0UNISON\u00e2\u20ac\u2122s position has been that the changes that were made to sickness payments (i.e. removing unsocial hours payments) do not have an automatic impact on Annex E, but the employers disagree with this.\u00c2\u00a0 They maintain that the principle of removing unsocial hours for periods of sickness absence should apply to staff paid under Annex E, and have proposed a methodology for how this deduction could be made.\u00c2\u00a0 \u00c2\u00a0\u00c2\u00a0<\/b><\/em><\/p>\n<p><em><b>UNISON, along with other staff side unions, does not agree that this deduction can happen automatically but has agreed to consult members on the proposal.\u00c2\u00a0 Your branch will be talking to you over the next few weeks about what the employers have proposed and what this could mean for you, and will be asking you to vote on whether you accept or reject.\u00c2\u00a0 <\/b><\/em><\/p>\n<p><em><b>Look out for more information and your ballot pack&#8221;.<\/b><\/em><\/p>\n<p style=\"text-align: center;\">____________________<\/p>\n<p><strong>Mao Tse Tung wrote that change comes through the barrel of a gun!
